Solar Mobility Act / Ordinance

Step 1: Pass the Solar Mobility Ordinance to define a fundable regulatory environment

  1. Mobility is physical liberty and should be sustainable and equitable:

THEREFORE, BE IT RESOLVED, To encourage economic development and transportation innovation, the ___CITY__or__STATE___ shall regulate grade-separated networks of self-driving vehicles by the following 5X5 Standard:

  1. Network construction must be privately funded. [[place risk on innovators, not taxpayers]]
  2. Networks must exceed 5 times the efficiency on existing roads (125 mpg or equivalent energy efficiency). [[metric driven]]
  3. Networks meeting the 5X efficiency standard are automatically approved unless rejected in writing, for any reason whatsoever, within 30 days of plan submission. [[remove bureaucratic delays and allow governments to enforce public interests]]
  4. Pay 5 percent of the gross transportation revenues to the aggregate rights-of-way holders. [[compensate the taxpayers for Rights of Way use]]
  5. Operate without government subsidies. [[place risk on innovators, not taxpayers]]
  6. Exceed safety performance of transportation modes already approved for use. [[improve safety]]
  7. Obtain Rights of Way access using the existing Rights of Way policies. [[existing for telecommunications and energy]]
  8. Are designed, fabricated, installed, insured, and inspected in compliance with International, ASTM International F24 standards for Amusement Rides and Devices (Disney monorail standard, Oklahoma Department of Labor). [[existing regulations, existing enforcement, existing common law, existing safety record 10,000 times better than roads (0.9 injuries per million versus 11,200 injuries per million on roads]]
  9. Gather more than 2 megawatt-hours of renewable energy per network mile per typical day. [[sustainable energy supply]]

Funding in available if cities adopt the known cost of regulations above. Goldman has since published an intent to invest $750 billion in the sustainability by 2030.

This is the fundable version:

  • Massachusetts Senate Bill S1993
  • Secaucus Law 2014-23 but subsequently blocked by NJDOT which caused capital to withdraw support.
    • Secaucus is very much like the Pacific Railroad Acts:
      • 1862 created a general framework, but no one would invest when the government held a first mortgage.
      • 1864 gave the railroads capacity to sell first mortgage bond and then it was even a struggle. Bold people risked everything to build the Transcontinental Railroads.
  • ​​The Solar Mobility Act combines and simplifies into a one page law the best of the laws that built the railroads, the 1934 Communications Act, and the building of the Internet based on standards (versus government plans).

Step 2: Why the ASTM Standard for Theme Parks

ASTM F24 Standards, regulated by the states, have a 10,000 times better safety record than Federal DOT:

  • 0.9 injuries per million using ASTM F24
  • 11,200 injuries per million using Federal DOT standards.

States, not the Federal government, are sovereign of "internal imprements" because of the Boston Tea Party. That demonstration against the government with war-powers trigged a war. To prevent mixing war-powers with commercial self-interests the Federal government is enumerated a limit of "post Roads" with "No Preference" in the commercial facilities of one state over another. There are 21 Presidential veto message that enforce the Divided Sovereignty of the Preamble ("provide" war-powers and only "promote" welfare).

Federalist #45:

"The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State."

For capital and innovators to risk, the law must be clearn and well established.

"What prudent merchant will hazard his fortunes in any new branch of commerce when he knows not but that his plans may be rendered unlawful before they can be executed? What farmer or manufacturer will lay himself out for the encouragement given to any particular cultivation or establishment, when he can have no assurance that his preparatory labors and advances will not render him a victim to an inconstant government? In a word, no great improvement or laudable enterprise can go forward which requires the auspices of a steady system of national policy."


The ASTM standards are used in 44 of 50 States and many nations. The ASTM standards:

  • Are widely used and well established.
  • Are tailored to pedestrians, especially children. Cities should be designed around pedestrians, not cars. Machines should adapt to people.
  • Have an existing enforcement industry.
  • Have an existing insurance industry.
  • Have an existing common law. This is very important because privately funded transportation networks will not have the sovereign immunity that protects DOT from poor safety performance.

Step3: Commercializing the Internet is a Model

The digitizing of communications networks, replacing analog networks with digital networks, required decades to get the regulation correct.

  • 1968:  "The Mother of All Demos" demonstrated nearly every aspect of modern computing and the Internet. A video is below. If you start at 29 minutes and watch for 5 minutes you will see graphical navigation, the mouse, video conferencing, and more.
  • 1982: The Federal communications monopoly created on Aug 1,1918 by Executive Order was declared unconstitutional.

This 1994 news cast illustrates how expectations at one point are entirely backward sounding today. All applications of technology to networks must keep ahead of expectation to remain relavant. Networks are dynamic processes, not static technology.
